Probably not. This would be a property claim. The law states that if you are hit while on your bicycle, by a motor vehicle, your insurance company will cove miscellaneous expenses such as damage to clothing, glasses, hearing aids, and other similar expenses. Essentially, your accident benefit insurer will pay for smaller items that may have been damaged in the bicycle accident and that are not otherwise covered by a property damage claim. We have had adjusters pay for bicycle helts and bicycle gear, but never a bicycle. This answer is pursuant to s. 24 of the accident benefit schedule.
